Request a free Greeley DUI case review

Seven questions, about a minute. Starts with your court date.

Step 1 of 7
Do you have a court date?

If your request is passed to an attorney, this tells them how fast to move.

When were you arrested?

License-suspension deadlines run from the date you were given the suspension notice, not from your court date.

Is this your first DUI or DWI?

Prior offenses change the charge level, the minimum penalties, and often the strategy.

Did you refuse a breath or blood test?

Refusal triggers a separate administrative case against your license.

How will you pay for legal fees?

Private defense attorneys are paid by the client. If your request is passed to an attorney, this tells them up front how you expect to pay.

Briefly describe what happened

A few sentences is plenty. Useful details: where you were stopped, why the officer said they stopped you, what tests you were asked to do, and anything that felt wrong about the stop.

How can you be reached?

This is the only step that asks for personal information.

By clicking “Send My Request,” I provide my ESIGN signature and express written consent for duistatelaws.com and up to three attorneys to contact me at the number provided, including through automated technology, SMS/MMS, and prerecorded or artificial voice messages. 2. Never to more than three. Only those attorneys and duistatelaws.com may use your details to contact you.
  3. You decide who, if anyone, you speak with. You are not committed to anyone.

Submitting this request does not create an attorney–client relationship.

The Weld County clerk and courts

The Centennial Center clerk’s office is open Monday to Friday from 7:30am to 4pm according to the main Weld County page (the collections page gives 8am to 4pm for the windows), on 970-475-2400, and opens at 8am on the fourth Wednesday of each month. The DMV clock, and what is due at sentencing

The license. Colorado gives 7 days from the notice to request a hearing from the DMV, independent of anything in Greeley.

Money. The court’s collections page says all fines and fees are due on the day of sentencing. Anyone who cannot pay in full that day fills out an application for a payment plan, online, by email to 19collections@judicial.state.co.us, by fax, or in person at the Court Collections Office on the first floor of the Centennial Center (970-475-2450, weekdays 8am to 4pm), and there is an annual $25 processing fee on every case. Payments can be made online, in person at the clerk’s windows, or by check or money order to Weld County Combined Courts, P.O. Box 2038, Greeley; telephone payments are not accepted.

The alcohol and drug evaluation

Colorado normally puts an evaluation between a DUI conviction and the sentence. Section 42-4-1301.3(1)(a) of the Colorado Revised Statutes says that on a conviction under section 42-4-1301 the court shall consider the alcohol and drug evaluation before sentencing. It may go straight to sentencing without it only if the defendant has no prior convictions or pending DUI charges, or the prosecutor and defendant have stipulated to the priors, and neither side objects. Even then, subsection (1)(b) says, the evaluation is done after sentencing and the court orders the education and treatment it recommends; a defendant who disagrees with the recommended program can ask for a hearing.

Subsection (3) has the judicial department run an alcohol and drug driving safety program in every judicial district, with pre- and post-sentence evaluations for everyone convicted of DUI and supervision of those whose sentence requires education or treatment. The report includes the defendant’s prior traffic record, any history of alcohol or drug problems and amenability to rehabilitation, and recommends a program. Level I is short-term didactic education; Level II covers therapeutically oriented education, long-term outpatient and comprehensive residential treatment; both levels are programs approved by the state’s behavioral health administration. The court must tell the defendant to meet all of the program’s financial obligations, and a program that is not paid notifies the court; the statute also lets treatment agencies apply for state money to recover Level II costs for defendants the court finds indigent.

Probation. Weld County Probation serves all communities in the county from offices at 822 7th Street, Suite 200, in Greeley and at 2960 9th Street in Fort Lupton, on 970-475-2800, and publishes a travel permit request form for people on probation.
