from the date you were served with the notice to demand a hearing from Georgia Department of Driver Services. The request goes to DDS, not to the court, and no judge in Cobb County will make it for you. O.C.G.A. § 40-5-67.1(g)(1).
Marietta is the seat of Cobb County, and the State Court of Cobb County sits on the town square. The court quotes the statute that sets its jurisdiction, O.C.G.A. section 15-7-4: the trial of criminal cases below the grade of felony, concurrent with the superior courts. That jurisdiction is shared, not exclusive, and the clerk’s own FAQ addresses drivers cited by a city police officer inside the county as a separate question, so check the court named on the citation.
What Cobb adds is a DUI Court for repeat offenders, with published terms, and a misdemeanor probation unit in the same building. The statewide penalties, the lookback and the license rules are on the Georgia DUI law page.

The license clock, and the first weeks
The license. Georgia gives 30 days from the notice to request an administrative license hearing from DDS, and the written request has to come with a $150 filing fee. That goes to the state, not to the Cobb court, and it does not wait for the criminal case.
The criminal case. The court publishes a brochure of basic rules for anyone ordered to appear and says it is not legal advice. Its clerk handles citations, the daily calendar and records searches. For a repeat DUI, the court lists among DUI Court’s eligibility conditions that the charges be sufficient to support a 24-month sentence.
| What happened | First time | With a prior | Authority |
|---|---|---|---|
| Convicted, first in five years | 12 months | — | O.C.G.A. § 40-5-63(a)(1) |
| Convicted, second in five years | — | 3 years | O.C.G.A. § 40-5-63(a)(2) |
| Refused the test | 1 year | — | O.C.G.A. § 40-5-67.1(d) |
Cobb County DUI Court
The court describes DUI Court as a voluntary, post-conviction, treatment-based program for people convicted of DUI more than once, offering enhanced supervision, counselling and treatment. It lasts at least 12 months, but the court says most participants need longer, so a sentence of at least 24 months is mandatory.
Who can apply. The court lists the conditions to be eligible for consideration: charged with a second DUI in ten years, a third or more in a lifetime, or a first DUI with a history of reckless driving convictions; charges sufficient to support a 24-month sentence; a Cobb County resident, with exceptions considered; 17 or older; an indication of alcohol or drug abuse or dependence; no prior violent felony convictions or current charges involving force; no out-of-state warrants; and a valid immigration status with no ICE holds.
What it costs and what it gives. The program costs $70 a week, covering treatment and testing; residential treatment or additional monitoring is extra. The court lists the benefits as less jail time, a reduction of fines by one-half conditioned on completing the program, 200 hours of community service credit for completing all phases, affordable treatment and testing, and supervision in meeting license reinstatement requirements. The statewide penalties it modifies are on the Georgia page.
