Request a free Redding DUI case review

Seven questions, about a minute. Starts with your court date.

Step 1 of 7
Do you have a court date?

If your request is passed to an attorney, this tells them how fast to move.

When were you arrested?

License-suspension deadlines run from the date you were given the suspension notice, not from your court date.

Is this your first DUI or DWI?

Prior offenses change the charge level, the minimum penalties, and often the strategy.

Did you refuse a breath or blood test?

Refusal triggers a separate administrative case against your license.

How will you pay for legal fees?

Private defense attorneys are paid by the client. If your request is passed to an attorney, this tells them up front how you expect to pay.

Briefly describe what happened

A few sentences is plenty. Useful details: where you were stopped, why the officer said they stopped you, what tests you were asked to do, and anything that felt wrong about the stop.

How can you be reached?

This is the only step that asks for personal information.

The Superior Court of California, County of Shasta, hears misdemeanor and felony cases at its Main Courthouse, 1515 Court Street in Redding. The criminal division lists DUI among its examples of misdemeanor violations, and the criminal clerk’s office is open from 8:30am to 4pm. The Shasta County Jail is run by the Sheriff’s Department, not the court; the court sends questions about people in custody to the Sheriff, on 530-245-6100.

Two cases, two clocks: the criminal track and the license track after an arrest A branching timeline. An arrest at the top splits into two lanes. The left lane, the criminal case, runs arrest and booking, charge filed, first court setting, pretrial settings, then trial, plea or dismissal, on a court docket measured in weeks to months with no filing deadline against the driver. The right lane, the license case, runs from the notice on day 0 to a short written deadline to demand a hearing, and then forks: a request filed in time gets a hearing, and state law decides whether the suspension waits for it, while nothing filed means the suspension starts automatically with no hearing. The Main Courthouse

Misdemeanors, felonies and warrants all require a court appearance, the criminal division says, and confirmed appearances are on the calendar; anyone who should be listed and is not should go to the Criminal Clerk’s Office with their paperwork. Defendants report directly to their assigned courtroom, whose doors generally open at 8am. Someone asking about a defendant brought to court in custody should go to the clerk’s office with the person’s name, date of birth and arresting agency.

The stages. The first hearing after an arrest is the arraignment, where the accused receives a copy of the complaint, is told the charges and their rights, and enters a plea. A pretrial hearing follows, with discovery and any motions. For a misdemeanor, the court says the jury trial must begin within 30 days of arraignment or plea if the defendant is in custody at arraignment, and within 45 days if not.

Paying a fine, or working it off

Fines can be paid in the clerk’s office by cash, money order, card or personal cheque, or by post with the case number. Instead of paying, a defendant can ask to convert the fine to community service, in the courtroom or at the clerk’s office, at $33 for each hour of work; Probation then assigns the work. Court-imposed fees cannot be converted and must be paid to the court’s collections division.

Bail under the 2026 schedule

The court’s judges adopted the 2026 Felony and Misdemeanor Bail Schedule under Penal Code section 1269b, effective January 20, 2026. For a misdemeanor DUI under Vehicle Code 23152(a), (b) or (c) it lists $2,500 — half the $5,000 that the 2026 schedules for Kern, Fresno and Santa Cruz counties list. With one prior conviction within ten years the figure is $5,000; with two or more it is $7,500, marked “DO NOT O.R.” — the schedule’s instruction that the person not be released on their own recognizance.

In the felony section, DUI with three or more priors, a felony under section 23550.5, and DUI causing bodily injury are each $50,000, and DUI causing death $100,000. Where a case has several misdemeanor charges, the bail is the highest amount for any one of them, not the sum.

The license. California gives 10 days from the notice to ask the DMV for a hearing.

Missed dates, unpaid fines and the public defender

Failing to appear. The court may issue a warrant, the prosecution may ask for added charges for the failure to appear, and the court says that can bring jail or a fine whatever happens to the original charge.

The civil assessment. If a fine is not paid as ordered, the court may impose civil penalties, and it quotes Penal Code section 1214.1(a): a civil assessment of up to $100 against a defendant who, after notice and without good cause, fails to appear or fails to pay all or part of a fine. Unpaid amounts go to the court’s comprehensive collection program, and penalty assessments may be added to any fine.

Court-appointed counsel. Where the public defender or other appointed counsel represents a defendant, the court will decide whether they can pay all or part of the cost; an order to pay has the force of a civil judgment, and the court may call the defendant back after the case to review ability to pay.

Appeals. In a misdemeanor case a notice of appeal must be filed within 30 days of the judgment or order.
